SANAYİ ÜRÜNLERİNDE GÜMRÜK VERGİLERİNİN ASKIYA ALINMASI UYGULAMASI ve KOTA BAŞVURULARI

             Üçüncü ülkelerden gümrük vergisi ile ithal edilen, Ülkemiz ile AB'ye üye ülkelerde yerli üretimi olmayan Gümrük Birliği kapsamındaki sanayi ürünlerine ilişkin her yıl 1 Ocak ve 1 Temmuz tarihlerinde yürürlüğe girecek şekilde yapılan askıya alma, üretimin tüketimi karşılamadığı ürünlerde ise kota başvurularının, ülkemiz temsilcilerinin de yer aldığı Avrupa Komisyonu Gümrük Kodu Komitesi Ekonomik Tarife Sorunları Grubu (ETSG) tarafından müzakere edilerek karara bağlandığı belirtilmektedir. (Askıya alma sistemi kapsamında  Türkiyede ve Avrupa Birliğinde  üretimi olmayan sanayi ürünleri için Askıya alma/ AB de ve Türkiyede üretimi bulunan ancak yetersiz olan ürünler için tarife kontenjanı uygulanmaktadır)

Gümrük vergisinin askıya alınması ve bu suretle gümrük vergisi oranının düşürülmesi veya sıfırlanması kararlaştırılan ürünlerin Toplulukla eş zamanlı olarak İthalat Rejimi Kararı Eki V Sayılı Listeye        yansıtılmaktadır

             Ulusal tarife kontenjanlarının ise Bakanlar Kurulu Kararı ve kotanın dağıtımına ilişkin yayımlanan Tebliğler çerçevesinde dağıtılmaktadır.


Askıya alma ve tarife kontenjanına ilişkin taleplerin alınmış olduğu  listede belirtilen GTİP ve tanımları yer alan eşyadan herhangi birini;

Üretimlerinde hammadde olarak kullanan bu eşyada vergi indirimini desteklemek isteyen firmaların bir dilekçe ile,

Ülkemizde üretimi olduğu gerekçesiyle gümrük vergisinin düşürülmesine itiraz etmek isteyen firmaların ise Ekte yer alan itiraz dilekçesine ek olarak    itiraz formu(Türkçe) ve itiraz formu(İngilizce) formlarla birlikte, müracaatlarını en geç 9/12/2016 tarihine kadar ilgili Bakanlık genel evrakına girecek şekilde iletmeleri gerekmektedir.
